Why were the devices recalled?
Due to a faulty design of metal-on-metal moving parts, both of these units have the ability to shed toxic metal fragments into the recipient’s body that can produce serious side effects such as
- bone fractures around the implant
- joint dislocation
- pain in walking and rising up from a chair
- swelling
- tumors.
How do I know if I’m affected by the DePuy recall?
Call me, Kara Jensen Zitnick, toll-free at 1-888-453-9018, and I will assist you in determining whether or not your device is under the recall.
Johnson & Johnson does not know which patients received the defective devices, so they will not be contacting you. All the company can do is to inform doctors and the public at large about the recall.
The doctor who performed your hip replacement surgery may call you if you have a recalled device, but it is a good idea for you to be proactive. We suggest you contact the doctor who performed your implant or the hospital where the surgery was performed to see if you have a recalled device.
My hip feels fine, do I need to do anything?
Yes! Even if you feel no pain, it is important to see your doctor. The doctor will test your blood to see if it contains microscopic metal fragments from the device. If fragments are found, this indicates the device is failing, putting you at risk of injury in the future. In this case, your doctor may determine that a second surgery is necessary to remove and replace the device.
In addition, a free case evaluation will help determine whether or not you need to take action today to protect your rights tomorrow. Call me at 1-888-453-9018 for a free case evaluation.
DePuy says they will pay for the surgery to remove and replace my hip replacement device, so why would I need a lawyer?
It remains to be seen what costs DePuy (owned by Johnson & Johnson) will actually cover. Johnson & Johnson, as a company, has had 11 product recalls since September 2009. It is in your best interest to speak with an attorney today who may help protect your rights for the future.
If you have received documents from DePuy, please contact me, Kara Jensen Zitnick, to find out how the recall affects you.
By law there is a limited period of time in which you may bring a legal action against DePuy for a failed ASR hip system, so don’t delay.
